Top 50 Nomination Terms and Conditions

  1. This Promotion is open to the 50 finalists from stage 1 of The Rose Project aged 18 or over, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion.
  2. Entrants must ensure that their participation (including acceptance of any prize) is lawful in accordance with the laws of their country of residence. This promotion is void where void under local national laws. The Promoter will not be taken to make any representations, express or implied, as to the lawfulness of any individual’s participation, or as to any other aspect of any Promotion.
  3. This Promotion is void where local laws or regulations prohibit such participation.
  4. No purchase necessary; however, internet access and a valid bank account are required.
  5. Promotion Period: Enter between 00:01 BST on 10 October 2024 and 23:59 BST on 25 October 2024 inclusive.
  6. To Enter: The Top 50 Rose Project Nominees must visit the link in the notification email sent to you and complete the form to provide further details as requested regarding your entry for The Rose Project and how you would spend the $20,000 in relation to your exceptional work, good cause or chosen charity.
  7. Further Entry Details:
    1. Content Restrictions:
      1. Entries must not include any content that infringes or violates the rights of any third party, including but not limited to, ownership, copyrights, trademarks, patents, logos, licensing rights, rights of publicity or privacy or any other intellectual property rights, excluding that of the Promoter.
      2. Entries must not disparage the Promoter or any other person or party affiliated with the competition;
      3. Entries must not include any products, trademarks, or copyrighted property of any other person or business entity nor include the names, likenesses, photographs, or similar of any individual;
      4. Entries must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libellous;
    2. Entries must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
    3. Entries must not contain material that is unlawful, in violation of or contrary to the laws or regulations in the United Kingdom; and
    4. The entry must not have been submitted previously in a promotion of any kind or exhibited or displayed publicly.
    5. In the event that an entry violates any of the above Content Restrictions, the Promoter may (at their sole discretion) crop or edit such entry to render it compliant and / or exclude such entry from the Promotion.
    6. By submitting an entry, each entrant grants to the Promoter a non-revocable, worldwide, royalty-free licence to use the copyright and other intellectual property rights vesting in their entry and other subject matter in connection with this Promotion for all purposes connected with this Promotion and future versions of The Rose Project which might exist, including but not limited to display on the Promoter’s website, owned social media channels and any other website of the Promoter or its agents/contractors choosing and use of the entry, or part(s) of the entry, in marketing materials relating to this Promotion for up to one year. Each entrant also grants the Promoter and its agents/contractors the right to moderate, modify or remove any entry if it is deemed unsuitable, in whole or in part, for display on the Promotion website or in any materials relating to the Promotion. Each entrant further waives their moral rights in their entry, including the right to be credited as the original creator of the Content, or where this is not possible, each entrant agrees not to enforce this moral right in a legal claim against us without first seeking an amicable resolution with the Promoter. Entrants hereby represent and warrant that they have all rights necessary to grant the licence and rights provided for in this paragraph and that all materials forming part of their entry to this Promotion, and any use of such materials by or on behalf of the Promoter, comply with all applicable laws, rules, and regulations and do not infringe or otherwise violate the intellectual property or other rights of any third party. By entering this Promotion, all entrants hereby grant the Promoter (or the Promoter’s designee) the exclusive right to use all their activities in connection with the Promotion and (if applicable) any prizes.
    7. Statements provided by Entrants may be used in whole or in part by the Promoter and its agents and licensors in advertising, marketing and PR materials (in any and all media throughout the world in perpetuity). Entrants hereby irrevocably agree to this use (which may or may not be accompanied by their first initial, surname and/or county subject to their consent and at the Promoter’s discretion). Entrants understand that the Promoter has the right but is not obliged to use such statements/quotes (in whole or in part) and to edit them as required, provided the original meaning is retained. Entrants hereby waive all, and agree not to assert any, moral or similar rights wherever in the world arising, and agree to sign/execute such further documents as are reasonably required of them by the Promoter in order to permit the Promoter (and its agents and licensors) to make use of the statements/quotes as described in this paragraph.
  8. Maximum of 1 entry is permitted per person during the Promotion Period. No nominee may win more than 1 Prize.
  9. The Prizes: There will be a total of 5 winners. Each winner will win 1 x $20,000 USD in cash (or local currency equivalent).
  10. Further Entry Prize Details and Conditions:
    1. All written answers must be between a minimum of 50 words per question and a maximum of 300 words per question.
    2. The optional supporting video must be a maximum duration of 2 minutes and shared as a Google Drive link in the submission, or as an MP4.
    3. Winners must have a valid bank account for the country in which they reside.
    4. Winners are responsible for providing correct bank account details and the Promoter will not be liable for any Prize payments made into the wrong bank account.
    5. The $20,000 Prize must be spent by the winner for the intended purpose outlined in their entry form to aid their exceptional work in the community or charity, or towards the good cause outlined in their entry and for no other purpose unless agreed with the Promoter in advance. Evidence may be required from the winner to prove that they have used the Prize as intended.
    6. The winners must complete a waiver declaring their eligibility to accept the prize in accordance with these Terms & Conditions and that the Prize will be spent on the intended purpose outlined in the entry form.
  11. Winner Selection: The Top 50 Rose Project Nominees entries (subject to moderation) will be independently judged by a panel of judges, including an independent party, within 55 working days from the close of the Promotion Period to select 15 shortlisted finalist nominees. Each of the questions in the nomination form will be judged against the following criteria:
    1. Question 1: Has unwavering dedication to a worthy cause or pursuit in the workplace/business, community or for the planet (max 10 points)
    2. Question 2: Has made a significant impact/measurable contribution through their project (max 10 points)
    3. Question 3: Has showcased inspiring or uplifting actions through their work/contribution (max 10 points)
    4. Question 4: Has showcased clear ambition to progress their project and continue making an impact (max 10 points).
    5. Tick Box: An unsung hero whose efforts or achievements have not yet received and deserve recognition (max 10 points).
    6. Supporting Video: (max 10 points)
      1. Has unwavering dedication to a worthy cause or pursuit in the workplace/business, community or for the planet;
      2. Has made a significant impact/measurable contribution through their project;
      3. Has showcased inspiring or uplifting actions through their work/contribution; and
      4. Has showcased clear ambition to progress their project and continue making an impact.

      The 15 shortlisted finalist nominees will then be judged by a panel of judges, by 15th January 2025 to select 5 provisional winners based on the same criteria.

      The 5 entries with the highest scores after judging will be deemed the provisional winners.

  12. Provisional winners may be required to submit to a confidential background check or to provide suitable information to answer questions to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the promotion as determined by the Promoter in its sole discretion. This will include all relevant banning orders or related incidents regarding the winner as required by a government, the police or relevant law enforcement agencies or organisations. Part of this process may also include questions during the claim process and a review of personal information sourced from data available in the public domain.
  13. The Promoter reserves the right to disqualify any provisional winner on the basis of the findings resulting from a background or information check and award the Prize to an alternative winner.
  14. Winner Notification: Provisional winners will be contacted via the email address provided on entry by 1st February 2025 and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winners. Once eligibility has been confirmed, the provisional winner will be confirmed as a Winner of The Rose Project. If a provisional winner does not respond to the initial contact within 28 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.
  15. Prize Acceptance:
    1. The winners will receive their cash prize via bank transfer.
    2. Winners are required to have a valid bank account in the country in which they reside.
    3. Communication to arrange fulfilment of a Prize and obtain a winner’s bank account details will take place within 14 days of acceptance of the Prize. Fulfilment of the Prize will take place within 28 days of a winner providing their bank account details. In the unlikely event that a winner has not received communication to arrange their Prize the winner must inform the Promoter by emailing [email protected] within a further 28 days. If a winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.
    4. Winners are responsible for providing correct bank account details and the Promoter will not be liable for any Prize payments made into the wrong bank account.
  16. Moderation: The Promoter reserves the right to reject entries which, in the reasonable opinion of the Promoter:
    1. are in breach of the Terms & Conditions;
    2. contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;
    3. contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks;
    4. promotes any political agenda.
  17. Provided no objection is received from the winners, a winners list containing the surname, region and country of residence of the 5 Rose Project Winners will be made available by the Promoter 4 weeks after the announcement of the winners, for a period of 8 weeks. It will be available by emailing [email protected]. Winners can object to their details being published during the Winner Notification process. Without prejudice, the Promoter will provide winner information to the Advertising Standards Authority when requested by them.
  18. The Promoter may request that the Top 50 Rose Project Nominees participate in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.
  19. The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
    1. Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
    2. Disqualify entrants who tamper with the entry process.
    3. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
    4. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
  20. The Prizes are not transferable or exchangeable and cannot be redeemed for any other form of compensation. If for any reason a Prize and/or any element of a Prizes is not available, the Promoter reserves the right, at its sole discretion to substitute that Prize or element of a Prize for another of equal or greater value.
  21. Any applicable taxes due on prize winners for accepting a prize are the responsibility of the winners.
  22. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the nomination form.
  23. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS14491) or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence.
  24. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.
  25. All personal data supplied for this Promotion will be used for the purpose of this Promotion and for research and analytical purposes by the Promoter and/or by any agent appointed by it to assist with running the Promotion and will not be disclosed to an unconnected third party unless your positive consent has been obtained. Your personal data will be handled in accordance with the Promoter’s privacy policy, available at: www.generalmills.com/privacy-security/uk-english-privacy-policy.
  26. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
  27. By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
  28. If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
  29. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
